For over 25 years Daniel Barkin has represented financial services and corporate clients in complex financing, commercial and corporate transactions and creditors rights matters. He recently joined the firm as a member, having spent his entire career at Lowenstein Sandler, where he was a partner.
Dan has extensive experience with a wide variety of financings, unsecured as well as secured by a variety of asset classes. These financings range from traditional syndicated and single lender asset-based loans to structured financings and securitizations, factoring and acquisition, debtor-in-possession, second lien, letter of credit, and mezzanine financings.
As counsel to certain Wall Street and other financial services clients, Dan has structured a variety of portfolio financings and acquisitions. These include mortgage warehouse repo financings and other performing and non-performing debt portfolio acquisitions and structured financings.
Dan has also represented a variety of financial services clients (including processors and Independent Sales Organizations) and national and regional retailers in payment and card transactions including private label programs, card, ecommerce and other payment programs.
Dan also has served as corporate counsel, representing companies in a variety of business matters involving strategic and succession planning, mergers and acquisitions, supply chain and other commercial transactions, corporate governance and trade and customer financing.
From the start, his practice has included representing diverse clients managing troubled credits, including loan workouts and the enforcement of secured creditor remedies and other creditors’ rights matters. Dan has handled bankruptcy, cash collateral, lien, adequate protection and inter-creditor disputes. He has represented secured creditors and purchasers in bankruptcy and UCC Article 9 asset sales.
Dan has had speaking engagements for bar associations, continuing legal education organizations, trade associations and clients. These have addressed a variety of subjects including perfecting liens in unusual or exotic collateral, lien perfection and priority disputes, secured party sales, agricultural liens, fraudulent transfers and avoiding lender liability.
